1. Agreement to These Terms

Welcome to waldomalan.com (the "Website"). The Website is operated by Malan Family Ministries Inc ("the Ministry," "we," "us," or "our"), a Florida not-for-profit corporation and a tax-exempt organization under Section 501(c)(3) of the U.S. Internal Revenue Code. It shares the teaching, books, podcast, newsletter, resources, coaching and speaking ministry of Waldo Malan.

These Terms of Use ("Terms") govern your access to and use of the Website and all content, forms, downloads and features available on it. By accessing or using the Website, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Website.

If you use the Website on behalf of a church, ministry or other organization, you confirm that you have authority to accept these Terms on its behalf.

2. Eligibility

The Website is intended for a general adult audience. You must be at least 18 years old, or the age of majority where you live, to submit forms, book services or make donations. Visitors under 18 may browse the Website and use its resources only with the involvement and permission of a parent or guardian.

3. Our Ministry Content and Intellectual Property

Unless otherwise noted, all content on the Website, including text, articles, newsletters, devotional writings, poetry, book descriptions and excerpts, podcast artwork, audio and video materials, musical compositions and scores, study guides, flashcards, worksheets, graphics, logos, photographs, and the design and arrangement of the Website (together, "Content"), is owned by Waldo Malan and/or Malan Family Ministries Inc, or is used with permission, and is protected by United States and international copyright, trademark and other intellectual property laws.

The names "Waldo Malan," "A Voice for Worship," "The Worship Letter," "Eternal Worship," the "WM" mark and related names, logos and titles are identifiers of our ministry. You may not use them in a way that suggests our endorsement or affiliation without our prior written permission.

Except as expressly allowed in Section 4, you may not copy, reproduce, republish, distribute, sell, license, modify, translate, create derivative works from, publicly display or otherwise exploit any Content without our prior written permission.

4. Permitted Use of Content and Free Resources

We want our resources to bless and equip as many worshippers, teams and leaders as possible. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • view, read, listen to and download Content for your personal, non-commercial use;
  • print and share our free resources (such as study guides, flashcards, worksheets and team tools) with members of your own church, ministry team, small group or class, free of charge, provided the materials are not altered and all copyright notices and attribution to Waldo Malan / waldomalan.com remain intact;
  • perform original musical compositions offered as free scores on the Website in live, non-commercial worship services and ministry settings, with credit to the composer. Churches are responsible for reporting such use through any licensing service (for example, CCLI) where applicable; and
  • quote brief excerpts of our written Content for review, teaching or commentary purposes, with clear attribution and, where possible, a link to the Website.

This license does not allow you to sell or charge for our Content; include it in any product, publication, course, recording or broadcast offered for sale; record, stream or broadcast our musical works commercially; post complete resources, newsletters or scores on other websites or file-sharing platforms; remove copyright notices; or use our Content to train artificial intelligence or machine-learning models. For any use not covered here, please contact us. We are often glad to grant permission.

Our books are sold through third-party retailers such as Amazon, and their use is governed by copyright law and the terms of the retailer from which they were purchased.

5. Acceptable Use

You agree to use the Website only for lawful purposes and in a way that is consistent with the respectful, Christ-centered spirit of our ministry. You agree not to:

  • use the Website in any way that violates any applicable federal, state, local or international law or regulation;
  • submit false, misleading or impersonating information, or use another person's identity or email address without permission;
  • send spam, chain letters, unsolicited advertising or bulk messages through our forms or contact details;
  • submit any content that is unlawful, defamatory, obscene, hateful, harassing, threatening or that infringes the rights of others;
  • upload or transmit viruses, malware or any other harmful code;
  • attempt to gain unauthorized access to the Website, its servers or any connected systems, or interfere with the Website's operation or security;
  • use bots, scrapers, crawlers or other automated tools to collect data or Content from the Website, except for standard search-engine indexing; or
  • use the Website or its Content to promote any commercial product or service without our consent.

We reserve the right to block access to, or refuse service to, anyone who violates these Terms.

6. Information You Submit

When you submit information through the Website, including booking and enquiry requests, newsletter sign-ups, messages or feedback, you confirm that the information is accurate and that you have the right to share it. Our use of your personal information is described in our Privacy Policy.

If you send us suggestions, ideas, testimonies or feedback ("Feedback"), you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use that Feedback for ministry purposes without obligation to you. We will not publish your name or personal testimony alongside it without your permission.

7. Coaching, Speaking and Booking Requests

Submitting a request through the "Book Me" form or otherwise contacting us about coaching, team intensives, speaking engagements, workshops, retreats or podcast interviews is an enquiry only. It does not create a binding agreement or guarantee availability. Any services will be confirmed separately in writing, and fees, schedules, travel arrangements, cancellation terms and other details will be set out in that separate agreement or proposal. If there is a conflict between these Terms and a signed services agreement, the services agreement will govern those services.

Any response time or "free discovery call" mentioned on the Website is offered in good faith, but it is not a contractual commitment.

8. Not Professional Advice

The Content on the Website, including podcast episodes, newsletters, devotional material, and coaching and leadership resources, is provided for general spiritual, educational and inspirational purposes. It reflects the personal views, faith and experience of Waldo Malan and his guests.

Life, leadership and worship coaching is not a substitute for professional medical, psychological, psychiatric, counseling, legal, financial or tax advice. Nothing on the Website creates a doctor–patient, therapist–client, attorney–client or similar professional relationship. If you are in crisis or need professional help, please contact a qualified professional or your local emergency services. In the United States, you can call or text 988 to reach the Suicide & Crisis Lifeline.

The views of podcast guests and third parties are their own and do not necessarily represent the views of the Ministry.

9. Donations and Partnership

Donations and monthly partnerships are processed by our third-party giving platform, Givebutter, and are also subject to Givebutter's terms of service and privacy policy.

  • Voluntary gifts. All donations are voluntary gifts to Malan Family Ministries Inc. No goods or services are provided in exchange unless stated in your receipt.
  • Use of funds. Examples of what gifts can provide (for example, "$10 gives a book") show typical ministry costs. All contributions are received into the Ministry's general fund and used at the discretion of its board of directors to further its charitable and religious purposes.
  • Tax deductibility. Malan Family Ministries Inc is a 501(c)(3) tax-exempt organization, and contributions are tax-deductible to the full extent permitted by law. We will provide a donation receipt. Please consult your own tax advisor about your situation. Donors outside the United States should note that gifts may not be tax-deductible in their country.
  • Refunds. Donations are generally non-refundable. If you believe a donation was made in error, such as a wrong amount or duplicate charge, please contact us within 30 days and we will review your request in good faith.
  • Recurring gifts. You may change or cancel a monthly partnership at any time through your Givebutter account or by contacting us. Cancellation applies to future payments only.

10. Third-Party Links and Services

The Website contains links to, and embedded features from, third-party websites and services, including Amazon, YouTube, Spotify, Apple Podcasts, RSS.com, Facebook, Instagram, LinkedIn, Givebutter and Formspree. These links are provided for your convenience. We do not control and are not responsible for the content, products, services, availability or privacy practices of any third-party site. Your use of them is at your own risk and subject to their terms and policies. Purchases of books through Amazon or other retailers are transactions between you and that retailer.

11. Disclaimer of Warranties

THE WEBSITE AND ALL CONTENT, RESOURCES AND FEATURES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. While we strive for accuracy, we do not warrant that the Website will be uninterrupted, secure or error-free, that Content is complete or current, or that the Website or downloadable files are free of viruses or other harmful components. You are responsible for taking your own precautions.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MALAN FAMILY MINISTRIES INC, WALDO MALAN, AND THE MINISTRY'S DIRECTORS, OFFICERS, VOLUNTEERS AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify, defend and hold harmless Malan Family Ministries Inc, Waldo Malan, and the Ministry's directors, officers, volunteers and agents from and against any claims, liabilities, damages, losses and expenses, including reasonable attorneys' fees, arising out of or relating to your violation of these Terms, your misuse of the Website or its Content, or your violation of any law or the rights of any third party.

14. Copyright Complaints

We respect the intellectual property rights of others. If you believe that material on the Website infringes your copyright, please send a written notice to the contact details in Section 19 that includes: (a) your physical or electronic signature; (b) a description of the copyrighted work you believe is infringed; (c) the location of the material on the Website; (d) your name, address, telephone number and email address; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf. We will review all notices and remove infringing material where appropriate.

15. Changes to the Website and These Terms

We may change, suspend or discontinue any part of the Website, its Content or its resources at any time without notice. We may also revise these Terms from time to time. When we do, we will post the updated Terms on this page and update the "Last Updated" date above. Your continued use of the Website after changes are posted means you accept the revised Terms.

16. Termination

We may suspend or end your access to the Website at any time, without notice, if we believe you have violated these Terms or applicable law. Sections 3, 6 and 8 through 18 will survive any termination.

17. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or to the Website are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, and by applicable U.S. federal law. You agree that any legal action shall be brought exclusively in the state or federal courts located in Collier County, Florida, and you consent to the personal jurisdiction of those courts. Before starting any formal proceeding, we encourage you to contact us so that we can try to resolve the concern informally and in a spirit of peace and reconciliation (Matthew 18:15).

18. General Provisions

These Terms, together with our Privacy Policy and any separate written services agreement, make up the entire agreement between you and the Ministry about the Website. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right. You may not assign your rights under these Terms. We may assign ours without restriction. Section headings are for convenience only.
